The Council is considering legislation (Legislative Resolution 20-O-9) to amend Town codes to allow fences of six feet in height in rear and side yards routinely, no Special Exception required. You can view the legislation, including proposed amendments, through the Town website at www.upmd.org/Draft-Fence-Ordinance.
The legislation was introduced at the October 5, 2020 Council meeting. The Council has been receiving written and verbal public comment, pro and con, regarding the proposed changes, and public comment continues to be welcome. At the November 16 Council meeting, I proposed some further amendments to reflect suggestions from public comment as well as Council discussion. These further amendments would require fences taller than 4’ in height incorporate openness and allow small garden fences in any yard and are shorter than 4 feet in the front yard and 6 feet in a side or rear yard. The legislation with amendments is scheduled for final Council consideration and possible adoption at the December 7 Council meeting. The Council is continuing to receive public comment on the proposed legislation. You can comment by emailing to Mayor and Council. Participants in the December 7 meeting will have the opportunity to speak during Public Comment. Public comments will be limited to three minutes.
Public comments or questions may also be made by emailing the Town Clerk Andrea Marcavitch at amarcavitch@upmd.org. by 6 p.m. prior to the meeting on December 7. Comments received will be read by the Town Clerk during public comment. Please share this with neighbors who may not be on the Mayor’s email list.
